TERMS OF USE OF SENSECA SPAIN S.A.U.

By using the WEBTRANS service included in the GEO-DATAVIEW package, you agree to these Terms of Sale, the SENSECA SPAIN Privacy Statement (see the Privacy and Protection of Personal Information section below), and the applicable terms and conditions, policies, or disclaimers found on the SENSECA website. We recommend that you read these terms of use carefully. YOU MAY NOT USE WEBTRANS IF YOU DO NOT ACCEPT THE POLICIES.

Terms relating to your use of WEBTRANS

1. User account.

You must provide us with current, complete and accurate information to register for the WEBTRANS service. You may also be required to accept a service agreement as a condition for opening the account. Your use of the service to access the application and the content within it will be subject to all the conditions governing the WEBTRANS account. For more information, please refer to the SENSECA SPAIN Service Agreement. You are responsible for maintaining the confidentiality of your account and password, as well as for all activities that occur under them.

2. No unlawful or prohibited use.

As a condition of using WEBTRANS, you warrant to us that you will not use WEBTRANS for any purpose that is unlawful or prohibited by these Terms of Sale, the WEBTRANS Guidelines, or any other terms that apply to your use of WEBTRANS. You may not use WEBTRANS in any manner that could damage, disable, overburden, or impair any SENSECA SPAIN server or networks connected to any SENSECA SPAIN server, or interfere with any other party's use and enjoyment of WEBTRANS. You may not attempt to gain unauthorised access to WEBTRANS, other accounts, computer systems or networks connected to any SENSECA SPAIN server or to WEBTRANS or METEODATA stations, through computer attacks, password mining or any other means. You may not obtain or attempt to obtain information through any means not intentionally made available through WEBTRANS. You may not use WEBTRANS in a manner that infringes the rights of third parties, including intentional damage to a person or entity, including SENSECA SPAIN.

Terms relating to the sale of services to you

3. Geographic availability.

Product availability may vary depending on your region or device. Additionally, there may be restrictions on the locations where we can provide services or digital content. To complete your purchase, you may be required to have a valid billing address within the country where you are making the purchase.

4. For end users only.

If the end user is different from the purchaser of the METEODATA station(s) that generate the data, they must justify the transfer of use in order to purchase the WEBTRANS service.

5. Billing.

By providing SENSECA SPAIN with a payment method, you:

  • declare that they are authorised to use the payment method they have provided and that all payment information they have provided is true and accurate.

  • authorise SENSECA SPAIN to charge you for the WEBTRANS services you purchase using the payment method you indicate.

  • authorise SENSECA SPAIN to charge you for the WEBTRANS service you use. You agree to promptly update your account information and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed. We can invoice you (a) at the time of purchase; (b) periodically in the case of renewals. We will notify you in advance of any changes to the amount of the periodic renewal services you will be charged. We can bill you at the same time for more than one previous billing period for amounts that have not been previously processed. See the “automatic renewal” section below.

6. Periodic payments.

Subscription charges are typically billed or collected in advance of the corresponding subscription period. If any credit card is rejected or denied, SENSECA SPAIN reserves the right to charge any applicable return, rejection, or insufficient funds fees and to process such payment as an Electronic Payment.

7. Availability and limits of quantities and orders.

Prices and availability of the WEBTRANS service are subject to change at any time.

SENSECA SPAIN may refuse or reject any order at any time, refunding any money you have paid for the order, for legitimate reasons including, but not limited to, if you have not met the conditions specified at the time of the order or if your payment cannot be processed.

8. Updates.

SENSECA SPAIN may need to update the WEBTRANS platform, among other reasons, to resolve issues, improve functions, or install add-ons and new versions. These updates may be necessary for the service to function correctly. By accepting these Terms, you agree to receive updates automatically.

9. Software licenses and usage rights.

The use of the software available through the WEBTRANS platform is granted under a licence agreement and is limited solely to use, not to ownership of the product or to the intellectual property rights (IPR) or patent thereof.

10. Prices.

The prices shown for the WEBTRANS service include any applicable taxes. Taxes will be added to your purchase amount and will appear on the checkout page before you finalise your order. You will be solely responsible for paying these taxes.

Depending on your location, some transactions may require currency conversion or processing in another country or region. Your bank may charge you additional fees for these services if you use a debit or credit card. Contact your bank for more information.

11. Automatic renewal selection.

We will send you an email notification a few days before the expiration date of the current service period. From this moment, you can renew by following the instructions indicated in that notification through the payment method provider. The payment date is set when the payment entity confirms the correct arrival of the payment. If the WEBTRANS service renewal is not paid before the expiration date of the current service period, access to the service will be automatically blocked.

12. Cancellation.

You can stop using WEBTRANS at any time. To delete your account and remove your data, please contact your business intermediary or, alternatively, the SENSECA SPAIN technical department at technicalsupport.madrid@senseca.com SENSECA SPAIN may suspend or cancel your access if you fail to comply with the Conditions described in this Agreement.

GENERAL TERMS

14. Changes in terms.

SENSECA SPAIN may modify the Terms of Sale at any time. The Terms of Sale in effect at the time you place your order will govern your service purchase transaction and will act as the transaction contract between us. Prior to your next transaction, SENSECA SPAIN may have modified the Terms of Sale for the service.

15. Privacy and protection of personal information.

Your privacy is important to us. We use the information we collect from you exclusively to operate and provide the WEBTRANS service.

16. Service update.

SENSECA SPAIN reserves the right to make changes to the WEBTRANS service conditions at any time whenever necessary to provide a quality service.

17. Termination of use or access.

SENSECA SPAIN may terminate your account or use of WEBTRANS for any legitimate reason, including, without limitation, breach of these Terms of Sale. By using WEBTRANS, you accept responsibility (in accordance with these terms) for any order you place or are charged prior to such termination. SENSECA SPAIN may change, interrupt or otherwise suspend WEBTRANS at any time, for any reason and with prior notice. If such change, interruption, or suspension affects your use of the Service, or otherwise disrupts your order, please contact Sales and Technical Support.

18. Disclaimer.

Nothing in this limitation of liability shall exclude or limit any mandatory consumer protections available to you in your territory, or any other liability that cannot be excluded by law. The same will apply to the liability of SENSECA SPAIN and/or its legal representatives in case of fraud.

a. Neither SENSECA SPAIN nor its legal representatives shall be liable for any indirect damage or loss, including economic loss such as loss of profits, unless SENSECA SPAIN or its legal representatives have committed at least gross negligence or willful misconduct.

b. SENSECA SPAIN will not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay arises from circumstances beyond SENSECA SPAIN's reasonable control (for example, labour disputes, natural phenomena, wars or terrorist activities, malicious damage, accidents, or compliance with applicable law or government regulation). SENSECA SPAIN will make every effort to minimise the effects of such events and fulfill its obligations that are not affected by them.

19. Assignment.

We may assign, transfer, or otherwise dispose of our rights and obligations under these Terms of Sale, in whole or in part, provided that such assignment, transfer, or disposal is not to your detriment, at any time and without notice. You may not assign or transfer any rights under these Terms of Sale.

20. Choice of law and venue for dispute resolution.

Spanish law will govern all claims relating to WEBTRANS Services, without prejudice to any mandatory legal provisions applicable in the country or region where you have your habitual residence. With respect to jurisdiction, you and SENSECA SPAIN agree to choose the courts of Madrid (Spain) to resolve all disputes arising out of or related to these Terms of Sale.

21. Notifications.

a. SENSECA SPAIN may disable or cancel the accounts of WEBTRANS service users who are repeat offenders.

b. Notice regarding intellectual property and trademarks. All content on WEBTRANS is protected by intellectual property rights. We own the title, copyright and other intellectual and industrial property rights of the WEBTRANS service, the names, logos and icons of all products and services registered by SENSECA SPAIN.

22. Safety warning.

To avoid possible injury, discomfort, or eye strain, you should take regular breaks from using the WEBTRANS service, especially if you experience pain or fatigue from its use. If you feel discomfort, take a break.
